Terms of Service

1. Services

Clicknexa Works provides professional design services including website design (landing pages, e-commerce), UX/UI design for applications, prototyping (Figma, Adobe XD), SaaS and dashboard design, and website redesign. All services are delivered remotely unless otherwise agreed in writing.

2. Project Engagement

All projects begin with a signed proposal or statement of work (SOW) and an initial deposit. Work commences only after the deposit is received. The scope, timeline, and deliverables are defined in the project proposal.

3. Client Responsibilities

Provide timely feedback within agreed review windows (typically 5 business days)
Supply all required content, assets, and access credentials on schedule
Designate a single point of contact for approvals

Delays caused by the client may result in revised timelines and additional fees.

4. Revisions

Each project phase includes a defined number of revision rounds as specified in the proposal. Additional revisions beyond the agreed scope will be billed at our standard hourly rate of $85/hr.

5. Payment Terms

A non-refundable deposit of 50% is required to begin work. The remaining balance is due upon project completion before final files are delivered. Invoices unpaid after 14 days are subject to a 1.5% monthly late fee.

6. Intellectual Property

Upon receipt of full payment, the client receives full ownership of the final deliverables. Clicknexa Works retains the right to display the work in its portfolio unless the client requests otherwise in writing. All preliminary concepts and unused designs remain the property of Clicknexa Works.

7. Confidentiality

Both parties agree to keep confidential any proprietary information shared during the project. This obligation survives termination of the agreement.

8. Limitation of Liability

Clicknexa Works is not liable for indirect, incidental, or consequential damages arising from the use of delivered work. Our total liability shall not exceed the total fees paid for the specific project in question.

9. Termination

Either party may terminate the agreement with 14 days written notice. The client is responsible for payment of all work completed up to the termination date. The initial deposit is non-refundable.

10. Governing Law

These terms are governed by the laws of the Commonwealth of Kentucky, USA. Any disputes shall be resolved in the courts of Hardin County, Kentucky.

Refund Policy

1. Deposit Policy

All projects require a 50% non-refundable deposit to reserve our time and begin work. This deposit covers initial research, discovery, and project planning and is not eligible for refund under any circumstances.

2. Mid-Project Cancellation

If a client cancels a project after work has commenced, they are responsible for payment of all work completed to date, calculated at our standard rate. Any amount paid beyond the work completed will be refunded within 14 business days.

3. Completed Projects

Once final deliverables have been approved and delivered, no refunds will be issued. Client approval (written or via email) constitutes acceptance of the final work.

4. Revision Disputes

If you are unsatisfied with a deliverable, we encourage you to request revisions within the agreed revision rounds before final approval. We are committed to working with you until the deliverable meets the agreed-upon brief.

5. Exceptional Circumstances

In rare cases where Clicknexa Works is unable to complete a project due to circumstances on our end, a full or partial refund will be issued proportional to the work not completed. We will communicate proactively and work to find a fair resolution.
